Under Virginia law, those who die without a will are “intestate,” and there is an order for inheritance. If a person dies without a will, one third of the assets go to the surviving spouse. The remaining two thirds go to the children. If there is no surviving spouse, all assets pass to the children and descendants. If there is no spouse or children, the assets go to the deceased’s father or mother. If the mother and father have passed, the deceased’s siblings inherit the assets.
